Once you paid, you automatically accept the terms of service.
If you need specific rights, prices may be raised.

01 - General Terms / Termes généraux

Prices are subject to change based on demand.
I have the right to reject any order for any reason.

Les prix sont variables, en fonction de la demande.
J'ai le droit de rejeter n'importe quelle commande, peu importe la raison.

02 - Payment / Paiement

Currency accepted is either USD or Euro and can be paid through PayPal or any French accessible payment service.
Commissions must be paid either 100% upfront.
Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment.

La monnaie acceptée est soit en USD, soit en Euro, et peut être utilisée via Paypal ou tout autre service de règlement accessible en France.

Les commission doivent être réglées soit à 100%.

Ne m'envoyez aucun paiement avant que nous n'ayons convenus le tout, et que je vous fasse la demande.

03 - Process & Delivery / Procédés & Livraison

The time it takes to finish your commission varies 1 week - 2 months depending on factors such as health, the complexity of the commissioned piece, other works, and con seasons.
Once the piece is finished you will receive the full-resolution image along with a web-friendly size. Note that there is no physical product. Depending on where you live, we can arrange to print your artwork. Just ask :)

Le temps pour réaliser votre commission varie : entre 1 semaine à 2 mois peuvent se passer dépendant de nombreux facteurs tels que ma santé, la complexité du travail demandé, des autres commissions ou encore de la saison des convention.

Une fois l'oeuvre finie, vous recevrez une image pleine résolution, avec des caractéristiques facilitant l'intégration web. Notez qu'il n'y a pas de produit physique. Dépendant d'où vous vivez, on peut s'arranger pour imprimer le produit final. Demandez :)

04 - Revisions / Révisions

You get 3 rounds of changes on the commissioned piece included in the price.
A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.
If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.
If your reference is unclear to start with changes will come at an extra charge.

Vous avez 3 changements gratuits possibles lors du processus de validation (dans la limite de prix disponible).

Une charge supplémentaire sera ajoutée si vous voulez que je modifie le produit final, à moins qu'il ne s'agisse d'une erreur de compréhension de ma part.

Si vous souhaitez que je change un élément déjà approuvé, vous aurez une charge supplémentaire. Ce montant dépend du changement et sera basé sur le salaire horaire.
Si vos références sont trop peu claires dès le départ et que vous demandez de nombreux changements, une charge sera ajoutée.

04 - Copyrights & Usage / Droits d'auteur et d'utilisation

I, "Arthenilis" (the artist):
- I reserve the right to cancel and refund the order at any time for any reason.
- I retain all copyrights over the commissioned artwork.
- I will NOT claim the intellectual property (IP) of the commissioned artwork.
- I will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.
- I reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books, unless both, the customer and I, agreed on specific rights.
You (the customer/commissioner):
- You may upload the commissioned artwork on any website and social channels.
- You must NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, make prints, etc.)
- You must NOT alter the commissioned artwork without my (the artist's) consent.
- You MAY be allowed to sell the artwork if it is a part of an Adoptable. Please discuss this with me prior to paying for the artwork.
- You retain the rights to the intellectual property (IP).
- You must NOT use the commissioned artwork for commercial purposes.
The following is considered copyright infringement:
- Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.
- Claiming the artwork as your own
- Altering the artwork without my consent (including total or partial use of any artificial intelligence)

Moi, "Arthenilis" (l'artiste):
- Je me réserve le droit d'annuler et rembourser n'importe quel commission, à n'importe quel moment et pour n'importe quelle raison.
- Je garde tous les droits de copyrights sur toutes mes commissions.
- Je ne réclame PAS les droits de propriété intellectuelle sur mes commissions.
- Je ne monétiserait PAS les commissions sauf si vous (le client) ne respectez pas en entier les termes généraux.
- Je me réserve le droit de poster en ligne les commissions réalisées, tel mon portfolio, livres d'arts, réseaux sociaux, à moins que les deux partis, moi et le client, aient conclu sur des droits spécifiques.
Vous (le client / commissionneur):
- Vous pouvez mettre en ligne l'oeuvre commandée sur n'importe quel site web et réseaux sociaux.
- Vous ne devez PAS faire quelconque profit de la commission (revente, redistribution, mise en ligne à accès payant, revendre des impressions, etc.)
- Vous ne devez PAS altérer la commission sans mon (l'artiste) consentement.
- Vous POUVEZ vendre si c'est lié à un Adoptable ou un CharaDesign, mais avec consultation en amont.
- Vous gardez les droits de propriétés intellectuelles.
- Vous ne devez PAS utiliser l'oeuvre commissionnée à des fins commerciaux. Si vous le souhaitez, demandez en amont.
Ce qui suit sera considéré comme non-respect et violations du copyright:
- Reproduire/utiliser les oeuvres copyrightés à des fins commerciales -ce qui signifie faire du profit de n'importe quelque manière.
- Prétendre que l'oeuvre vient de vous et que vous l'avez produit.
- Altérer l'oeuvre sans mon consentement (inclus l'utilisation d'intelligence artificielle, totale ou partielle)

06 - Cancellation & Refund policy /
Annulation & Politique de remboursement

The buyer is not allowed a refund once I started working on the commission.
If for any reason I am unable to start your commission you will receive a full refund.
If you cancel your order before I started it, you can get a full refund.
If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.
If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.

Le clien/acheteur n'est pas remboursé une fois que j'ai commencé à travailler sur la commission.
Si, pour quelque raison, je ne peux pas travailler, je m'engage à rembourser à 100%.
Si vous annulez votre/vos commandes avant validation, vous pouvez être complètement remboursé.
Si vous êtes remboursés, ne passez pas par le remboursement Paypal. Je vous transfèrerai l'argent moi-même.
Si vous demandez un remboursement via Paypal sans y être autorisé et/ou sans raison, vous perdrez tous les droits mentionnés précédemment sur l'oeuvre et je pourrais l'exploiter pleinement. Je refuserais le remboursement and contacterais Paypal avec nos conversations ainsi que la commission pour prouver mon travail complété envers vous. De plus, vous serez sur liste noire pour toute nouvelle requête.
